On apprend que Schaffer a reconnu avoir menti : il n'était pas juste un simple sympathisant de sa milice, mais carrément un des fondateurs. C'est à partir de ce revirement que ces avocats ont pu commencer à négocier.

La négociation sur sa peine devrait se situer entre 3 et 4 ans de prison (il en risque 20 + 10 sur les 2 chefs d'accusation), en fonction de sa bonne volonté à coopérer. Il devra tout déballer sur les activités et les membres de sa milice, et aussi sur leurs éventuelles connexions avec les Proud Boys, ce mouvement néo-fasciste réservé aux hommes des soutiens absolus de Trump.

Il lui a été offert la possibilité de bénéficier du régime de protection des témoins, car avec son déballage, Schaffer va en effet passer du statut de héros des conspirationnistes et Trumpistes à celui de traitre à la cause. Les autorités craignent visiblement que sa tête soit mise à prix à sa sortie de prison.

Au-delà des idéaux et des slogans pour sauver l'Amérique du "complot", à la fin ça reste chacun pour soi.
Earlier today, Glenn Kirschner, a former federal prosecutor, joined Jonathan Capehart of MSNBC's "The Last Word With Lawrence O'Donnell" to discuss how prosecutors "will wring every drop of criminal information out of" ICED EARTH guitarist Jon Schaffer, who pleaded guilty in the Capitol riot investigation.

Asked how important this guilty plea from Schaffer is, Kirschner said (see video below): "It's actually pretty consequential, because this is not as some people have said just a glorified trespassing guilty plea. This is actually a guilty plea with cooperation, which we'll talk about in a minute, but it's a guilty plea for a crime that involves breaching the Capitol with the intent to impede a congressional inquiry specifically the Electoral College vote count. And when we realize that defendant Schaffer bills himself as a founding member of the Oath Keepers, this is where the cooperation part of the guilty plea comes into play because I can tell you, today was not sort of the first step in a cooperation agreement with defendant Schaffer. This has been going on for some time.

"Anytime a defendant approaches the prosecution, and it wants to consider pleading guilty and cooperating, what we do is we sit down across the table with that aspiring cooperating defendant and we basically make them tell us everything they know about criminal activity," he continued. Not only criminal activity they've perpetrated, but all of their fellow Oath Keepers, all of their fellow insurrectionists. And then we go about trying to corroborate all that information before we ever strike a plea and cooperation agreement with them."

Asked if this guilty plea is the first of many or it is a guilty plea that is meant to send a signal to the other folks out there who are either have been arrested, charged, or trying to get deals to get their deal now or they're going to be out of luck, Kirschner said: "I think it serves both of those purposes. Think about this. This man fancies himself as one of the founding members of the Oath Keepers. Now, I'm not suggesting that the Oath Keeper organization has been involved in other criminal activity, but if it has, you can bet the prosecutors are going to wring every drop of criminal information out of defendant Schaffer, not only about the run up to January 6th, not only about the attack on the Capitol on January 6th, but anything the Oath Keepers have been up to. And let's remember, there was some coordination between the Oath Keepers and the Proud Boys. So, you know, I think defendant Schaffer can also provide information potentially about the Proud Boys organization. So, this is like the first cooperator shot fired across the bow, and I predict this is going to start the dominos falling. You're going to see other guilty pleas. You're going to see other cooperators. And the big ticket question is how far up the criminal food chain can these kind of cooperating defendants take the government."

Although Schaffer was initially charged with six crimes, including engaging in an act of physical violence and targeting police with bear spray, he pleaded guilty to only two charges: obstruction of an official proceeding of Congress; and trespassing on restricted grounds of the Capitol while armed with a deadly or dangerous weapon. The first charge is punishable by up to 20 years in prison, while the second carries up to a 10-year prison term.

According to CNN, prosecutors and Schaffer's attorneys agreed to recommend that he get between three and a half and four and a half years in prison, based on how fruitful his cooperation is with the government.

In his plea agreement, Schaffer acknowledged that on January 6, 2021 he was in Washington to attend the "Stop The Steal" rally at the Ellipse in Washington, D.C. to protest the results of the presidential election, which he believed were fraudulent. Schaffer wore a tactical vest and carried bear spray, a dangerous weapon and chemical irritant used to ward off bears. When the rally finished, Schaffer joined a large crowd that marched from the Ellipse to the Capitol, where a joint session of Congress, presided over by Vice President Michael Pence, was in session to certify the electoral college vote results. Shortly after 2:00 p.m., members of the mob forced entry into the Capitol building, disrupting the joint session and causing members of Congress and the Vice President to be evacuated from the House and Senate chambers.

In his plea agreement, Schaffer admitted that after arriving on Capitol grounds, he walked past barriers intended to restrict access to the public and to a set of locked doors on the Capitol's west side. At approximately 2:40 p.m., Schaffer positioned himself at the front of a crowd that broke open a set of doors being guarded by four U.S. Capitol Police (USCP) officers wearing riot gear. Schaffer admitted to being among the first individuals to push past the damaged doors and into the Capitol building, forcing officers to retreat. Schaffer and others advanced toward five or six backpedaling USCP officers while members of the mob swelled inside of the Capitol and overwhelmed the officers. The officers ultimately deployed a chemical irritant to disperse the mob. Schaffer was among the people who were sprayed in the face, after which he exited while holding his own bear spray in his hands.

As part of the plea deal, Schaffer agreed to cooperate with investigators and potentially testify in related criminal cases, according to CNN. In return for Schaffer's assistance, the Justice Department might later urge the judge to show leniency during his sentencing.

As part of the agreement, the Justice Department has offered to sponsor Schaffer for the witness protection program.

The 53-year-old musician is the first Capitol riot defendant to reach a plea deal.

Suite à son engagement de coopérer et balancer ses copains, Schaffer a été remis en liberté conditionnelle. Il sera jugé plus tard.
On April 16, Iced Earth mastermind Jon Schaffer, who notoriously participated in the seditious riot at the U.S. Capitol on January 6, entered into a plea bargain with federal prosecutors. The deal will see him cooperate with authorities by sharing information with them about other conspirators in exchange for a lessened sentence.

That same day, as part of his plea deal, Schaffer was freed from detention. He had been held in custody since turning himself in on January 17, first in a facility in Marion County, IN, and then in Washington D.C. after extradition. The total length of Schaffer’s imprisonment was 89 days, and his release comes exactly 100 days after the attack on the Capitol. He will need to return to court for sentencing at a later date and his movements will be restricted and monitored in the meantime.

Guitarist Luke Appleton joins Blaze Bayley’s band

The final member of the group Absolva that wasn’t part of former Iron Maiden frontman Blaze Bayley‘s backing band has joined the fold as guitarist Luke Appleton has joined his brother / lead guitarist Chris Appleton, bassist Karl Schramm and drummer Martin McNee in Bayley‘s solo band. About two and a half months ago, Luke Appleton left the heavy metal band Iced Earth after nine years and just as the group’s leader Jon Schaffer was arrested for his rôle in the riot at the United States Capitol in Washington, D.C. back on January 6, 2021.

The following message was posted in part on Bayley‘s Facebook page earlier today:

“Many of you will know Luke from our Iron Maiden 25th Anniversary performances, and also from Absolva. We’re now delighted to announce that he is to fully join our ranks on guitar.

Blaze explains “I am very excited to have the magnificent talent of Luke Appleton added to my touring band. He is in the the rôle of power guitarist. The first thing we tried with the new line-up was the live stream from KK Downing’s venue (KK’s Steel Mill) and it felt outrageously good! L'avocat de Schaffer, après avoir parlé de son client "présumé innocent" (à tort car il a lui-même plaidé coupable! :crazy:), affirme que les petits copains de Schaffer en prison n'étaient pas très accueillants, ces deniers lui auraient même lancé des excréments et de l'urine.
Il aurait donc passé "2 mois en enfer" lors de sa découverte du système carcéral.
ICED EARTH guitarist Jon Schaffer claims to have gone through "two months of hell" in jail after he was detained for his involvement in the January 6 Capitol riots.

Earlier today (Friday, July 23), Indianapolis Star published a detailed account based on Marion County Jail incident reports which reveal Schaffer was kept in "Administrative Segregation" after he was arrested by law enforcement in Noblesville, Indiana on January 17 because of his high-profile status.

Although Schaffer had no contact with other inmates while he was in his cell or out performing recreation, according to a spokesperson for the Marion County Sheriff's Office — the jail's custodian — nor was he ever taken out of administrative segregation, his lawyer claims that he was targeted with death threats and assaulted with human excrement while he was behind bars.

"My client, who is presumed innocent, has just gone through two months of hell where other people were throwing feces at him and urine at him and threatening his life in a horrible, horrible situation," Schaffer's attorney Marc J. Victor told a federal judge in March during Schaffer's detention hearing in the U.S. District Court for the District of Columbia. "Shame on us, Judge, that this is happening in our justice system," Victor added.

Schaffer was removed from his cell block on March 7 after he said he "was in fear for his personal safety," according to a deputy with the Marion County Sheriff's Office. Schaffer informed the deputy about problems he was having with a specific inmate. The next day, Schaffer complained that three inmates, including the one mentioned in the March 7 report, were making death threats against him.

In April, Schaffer pleaded guilty to his rôle in the Capitol riot. As part of the plea deal, Jon entered into a cooperation agreement with the government.

De mon côté, je suis déçu par ce qu'il a fait évidemment, mais je reste attaché au musicien et au groupe.
J'espère qu'il continuera à faire de la musique dès qu'il le pourra et qu'il nous donnera aussi quelques explications dès qu'il pourra s'exprimer de nouveau.

Peut-être même qu'il aura eu le temps de trouver quelques bons riffs pendant ses vacances forcées :D il faudra juste trouver quelques musiciens, bon ça devrait aller aux Etats-Unis...

Oui et non: on est en présence de deux foutus racistes, mais c'est vrai que Shaeffer n'a tué personne. Sauf qu'il prendra proportionnellement très cher; Vikernes serait sans doute à perpète aux USA.

Maintenant si tu veux du vrai cynisme d'enc..., je parie qu'un assassin fera vendre plus de galettes. Je peux me tromper faute de réelles stats. Mais Burzum n'est vraiment pas difficile à trouver. Réputation sulfureuse, provoc, opinions débiles, y a de quoi toucher du public avant même de parler du projet artistique de Vikernes.

Shaeffer sera peut-être assez malin pour jouer au martyr, il aura un large public gagné d'avance .

La vraie question qui nous intéresse, puisque ce sont des événements ne nous touchant pas réellement, c'est la nécessité ou non de détacher le bonhomme et ses opinions de ses œuvres.

oui, ça c'est difficile par contre.
Sinon plus personne écouterait le groupe du boucher de Vilnius, Motley Crue (avec Tommy "wifebeater" Lee), Emperor et son batteur homophobe, Nugent qui est pro Trump, RATM qui sont pro communisme, et sûrement d'autres que j'oublie.

Après l'état fédéral, Schaffer (ainsi que 31 de ses "potes") est également poursuivi par le procureur général du district de Washington :
ICED EARTH guitarist Jon Schaffer is one of more than two dozen members of the Oath Keepers and the Proud Boys who are being sued by District of Columbia Attorney General Karl Racine in an effort to recover the millions of dollars the city spent to defend the U.S. Capitol during the January 6 attack.

According to CNN, the lawsuit filed Tuesday in federal court in Washington, DC, accuses 31 members of the extremist groups of "conspiring to terrorize the District" on Jan. 6, calling their actions "a coordinated act of domestic terrorism." The lawsuit cites the Ku Klux Klan Act of 1871, a federal law created after the Civil War to protect civil rights and, as Racine noted, "to protect against vigilantes and insurrectionists."

"I think the damages are substantial," Racine told The Washington Post. "If it so happens that it bankrupts or puts these individuals and entities in financial peril, so be it."

The 84-page complaint, which can be found at this location, describes Schaffer as "a founding, lifetime member of the Oath Keepers." It goes on to say: "Schaffer was criminally charged and indicted for his rôle in perpetrating the January 6th Attack. In connection with a promise to cooperate with investigators and potentially testify in criminal cases related to the conspiracy to commit the January 6th Attack, Schaffer pleaded guilty to the entire Statement of Offense in the criminal action brought against him, which included two felony offenses: (1) trespass of the Capitol while armed with a deadly or dangerous weapon and (2) obstruction of an official proceeding of Congress. The Criminal Complaint filed against Schaffer—as well as Schaffer's Plea Agreement and the accompanying Statement of Offense describing his conduct—are publicly available documents that are hereby incorporated into the Complaint by reference."

"No one bore the brunt of this gutless attack more than the courageous law enforcement officers including the men and women of the DC Metropolitan Police Department who went into the fire and violence with one objective in mind: remove the violent mob and restore our country's fragile democracy," Racine said at a news conference.

"The defendants, as you know, were not tourists, nor were they acting patriotically," he added. "They were vigilantes, members of a mob, insurrectionists who sought to crush our country's freedoms."

ICED EARTH founder, songwriter, guitarist and producer Jon Schaffer has released "A Narrative Soundscape", an audio CD of 15 tracks that was originally made available with the purchase of the deluxe edition of his first-ever book "Wicked Words And Epic Tales". These recordings are a completely re-imagined delivery of the lyrics of ICED EARTH songs created exclusively for this release. Longtime collaborator Jim Morris worked with Schaffer on these versions.

"Wicked Words And Epic Tales" is a collection of lyrics, interviews and pages of artwork that Schaffer's work has inspired throughout the years. The book is an anthology of lyrics from Schaffer that span his 35 years in making music in various projects, including ICED EARTH, DEMONS & WIZARDS, SONS OF LIBERTY and PURGATORY. The book comes in two unique covers: one created by Jonboy Meyers and another by Jim Balent and Roy Young, and is over 200 pages. The coffee-table art book also features original drawings from some of the most notable artists, including Todd McFarlane, Greg Capullo, Monte Moore and numerous others.

"I wanted to put something together that would be a truly unique experience not only for the fans of my bands, but for newcomers as well," Schaffer previously said.

"Wicked Words And Epic Tales" was the debut release from Schaffer's publishing company Wicked Words, LLC and was the first of many original concepts he planned for future release.

Released on January 21 via Ravencraft Productions, "A Narrative Soundscape" features the following tracks:

Last April, Schaffer pleaded guilty to his rôle in the January 6, 2021 U.S. Capitol riot. As part of the plea deal, Jon entered into a cooperation agreement with the government.

Following the initial reports that Schaffer was involved in the riot, his ICED EARTH bandmates distanced themselves from his actions. Singer Stu Block and bassist Luke Appleton later posted separate statements on social media announcing their resignations. BLIND GUARDIAN frontman Hansi Kürsch also quit DEMONS & WIZARDS, his long-running project with Schaffer. The allegations also apparently affected Schaffer's relationship with his longtime record label Century Media, which had released albums from both ICED EARTH and DEMONS & WIZARDS. As of mid-January 2021, the Century Media artist roster page did not list either band.

Last month, a lawsuit was filed in federal court in Washington, D.C. accusing 31 members of Oath Keepers and the Proud Boys — including Schaffer — of "conspiring to terrorize the District" on January 6, 2021, calling their actions "a coordinated act of domestic terrorism." According to CNN, the lawsuit cites the Ku Klux Klan Act of 1871, a federal law created after the Civil War to protect civil rights and, as District of Columbia Attorney General Karl Racine noted, "to protect against vigilantes and insurrectionists."

"I think the damages are substantial," Racine told The Washington Post. "If it so happens that it bankrupts or puts these individuals and entities in financial peril, so be it."

Although Schaffer was initially charged with six crimes, including engaging in an act of physical violence and targeting police with bear spray, he pleaded guilty to only two charges: obstruction of an official proceeding of Congress; and trespassing on restricted grounds of the Capitol while armed with a deadly or dangerous weapon. The first charge is punishable by up to 20 years in prison, while the second carries up to a 10-year prison term.
