C'est fou de perdre les pédales à ce point. Après c'est vrai qu'on en entend beaucoup en France dire qu'il faut une "révolution" pour changer les choses mais bon... Même les gilets jaunes ne sont pas allés si loin il me semble.

C'est pour ça qu'on aurait dû foutre Schaffer en taule depuis bien longtemps !

(Je fais le méchant car les derniers albums ne me déplaisent pas non plus :maisbiensur: )

Cela devait arriver, la première parodie de Schaffer sort sous le nom de Flattened Earth (Terre aplatie, belle référence :D).
Pendant ce temps, il attend toujours son extradition et reste en prison dans l'Indiana.

"pauvre" ?

Même si il fait (faisait ?) du bon boulot au sein de Iced Earth il n'a que ce qu'il mérite dans ce cas.

Un petit compte-rendu de Schaffer à son audience. En gros sa ligne de défense est qu'il était là en simple touriste inoffensif, limite par hasard.
Pour l'instant cette stratégie ne fonctionne pas des masses au vu des éléments dont dispose l'accusation, du coup le juge le garde en taule.

“In response to the Government’s exhibit of Mr. Schaffer speaking at a rally in November 2020, Mr. Schaffer argues that he was simply explaining his political views. When asked about violence in the video interview, Mr. Schaffer responded that he didn’t want violence, but that he was prepared to meet any violence with self defense. In response to the video that shows him entering the Capitol, Mr. Schaffer argues he was only in the building for 60 seconds and only unholstered the bear spray in question because he thought someone was trying to take it. Mr. Schaffer said he is not a flight risk because he voluntarily contacted his lawyer and surrendered himself. He is a high profile musician so would have difficulty fleeing. He has a stable girlfriend, stable residence, and a daughter. He is 52 years old with no criminal history or substance abuse problems. Mr. Schaffer argues the weight of the evidence is weak, as the Government did not provide evidence that he knowingly entered the Capitol building unlawfully. There was no evidence of violence presented and Mr. Schaffer says he is not affiliated with the ‘Oath Keepers.’

“Mr. Schaffer is charged with carrying a dangerous weapon (bear spray) onto restricted, Capitol grounds. His actions on January 6, 2021, during the certification of the electoral college vote, were shocking to the rule of law and the democratic process. As Chief Judge Howell noted in United States v. Barnett, the title of the offense does not ‘properly capture the scope of what [the defendant] is accused of doing here.’ In this case, there appears to be premeditation and a weapon present. Mr. Schaffer appeared in the video to be one of the first people to breach the Capitol. There is some evidence, and evidence still being developed, that defendant is affiliated with groups that present ongoing threats of danger to the community, e.g., the ‘Oath Keepers.’

“The government presented a number of exhibits at the detention hearing that show Mr. Schaffer was in possession of bear spray. There is video of him clearly entering the Capitol and three police officers that appear to fall back in self defense. Thus, it doesn’t seem likely or reasonable Mr. Schaffer was under the impression he was ‘invited in’ by Capitol law enforcement.

“Mr. Schaffer has no criminal history and no documented history of substance abuse. He is employed and has a stable residence. It is true he is within his rights to demonstrate and share his political views through lawful means. This case concerns unlawful means of demonstration. Mr. Schaffer’s status as a firearms owner does not have any bearing, negative or positive, on this decision.

“While Mr. Schaffer is most likely not a serious flight risk due to his status as a well-known musician, there remains the concern of danger to the community. Mr. Schaffer’s views on the government and current administration are long held. His statements, including the November 2020 interview, show that this was not an isolated event. He has stated there would be ‘bloodshed’ if the current administration came to power. This transfer of power has taken place, so it cannot be assured Mr. Schaffer will not engage in further violence to support his political ideology if released. The Government alleges Mr. Schaffer is a lifetime member of the ‘Oath Keepers,’ which is an organization that has questioned the legitimacy of the government and threatened political violence. Last, although Mr. Schaffer claimed he would only respond to violence in self defense, there was no violence directed against him on January 6, 2021, yet he engaged in violent and destructive behavior when he entered the Capitol armed with a weapon.”

Cela aurait pu être le cas, commencer par réaliser à quel point il s'est laissé manipuler, prendre du recul et repartir sur de nouvelles bases.
Mais pour l'instant il choisit l'option inverse de s'entêter et de jouer les victimes, en niant notamment ses liens avec sa fameuse milice, ce qui est grotesque quand on sait à quel point il en relaie le discours depuis une décennie. Je ne sais pas trop ce qu'il espère avec une telle stratégie.

Il va quand même devoir balancer ses copains de milice pour bénéficier d'une réduction des charges contre lui, et collaborer avec les enquêteurs, ce n'est pas gratuit. Au final quand des années de prison sont en jeu, les élans "révolutionnaires" se calment un peu...

Plus de détails par un Procureur fédéral, ci-dessous.
On apprend que Schaffer a reconnu avoir menti : il n'était pas juste un simple sympathisant de sa milice, mais carrément un des fondateurs. C'est à partir de ce revirement que ces avocats ont pu commencer à négocier.

La négociation sur sa peine devrait se situer entre 3 et 4 ans de prison (il en risque 20 + 10 sur les 2 chefs d'accusation), en fonction de sa bonne volonté à coopérer. Il devra tout déballer sur les activités et les membres de sa milice, et aussi sur leurs éventuelles connexions avec les Proud Boys, ce mouvement néo-fasciste réservé aux hommes des soutiens absolus de Trump.

Il lui a été offert la possibilité de bénéficier du régime de protection des témoins, car avec son déballage, Schaffer va en effet passer du statut de héros des conspirationnistes et Trumpistes à celui de traitre à la cause. Les autorités craignent visiblement que sa tête soit mise à prix à sa sortie de prison.

Au-delà des idéaux et des slogans pour sauver l'Amérique du "complot", à la fin ça reste chacun pour soi.
Earlier today, Glenn Kirschner, a former federal prosecutor, joined Jonathan Capehart of MSNBC's "The Last Word With Lawrence O'Donnell" to discuss how prosecutors "will wring every drop of criminal information out of" ICED EARTH guitarist Jon Schaffer, who pleaded guilty in the Capitol riot investigation.

Asked how important this guilty plea from Schaffer is, Kirschner said (see video below): "It's actually pretty consequential, because this is not as some people have said just a glorified trespassing guilty plea. This is actually a guilty plea with cooperation, which we'll talk about in a minute, but it's a guilty plea for a crime that involves breaching the Capitol with the intent to impede a congressional inquiry specifically the Electoral College vote count. And when we realize that defendant Schaffer bills himself as a founding member of the Oath Keepers, this is where the cooperation part of the guilty plea comes into play because I can tell you, today was not sort of the first step in a cooperation agreement with defendant Schaffer. This has been going on for some time.

"Anytime a defendant approaches the prosecution, and it wants to consider pleading guilty and cooperating, what we do is we sit down across the table with that aspiring cooperating defendant and we basically make them tell us everything they know about criminal activity," he continued. Not only criminal activity they've perpetrated, but all of their fellow Oath Keepers, all of their fellow insurrectionists. And then we go about trying to corroborate all that information before we ever strike a plea and cooperation agreement with them."

Asked if this guilty plea is the first of many or it is a guilty plea that is meant to send a signal to the other folks out there who are either have been arrested, charged, or trying to get deals to get their deal now or they're going to be out of luck, Kirschner said: "I think it serves both of those purposes. Think about this. This man fancies himself as one of the founding members of the Oath Keepers. Now, I'm not suggesting that the Oath Keeper organization has been involved in other criminal activity, but if it has, you can bet the prosecutors are going to wring every drop of criminal information out of defendant Schaffer, not only about the run up to January 6th, not only about the attack on the Capitol on January 6th, but anything the Oath Keepers have been up to. And let's remember, there was some coordination between the Oath Keepers and the Proud Boys. So, you know, I think defendant Schaffer can also provide information potentially about the Proud Boys organization. So, this is like the first cooperator shot fired across the bow, and I predict this is going to start the dominos falling. You're going to see other guilty pleas. You're going to see other cooperators. And the big ticket question is how far up the criminal food chain can these kind of cooperating defendants take the government."

Although Schaffer was initially charged with six crimes, including engaging in an act of physical violence and targeting police with bear spray, he pleaded guilty to only two charges: obstruction of an official proceeding of Congress; and trespassing on restricted grounds of the Capitol while armed with a deadly or dangerous weapon. The first charge is punishable by up to 20 years in prison, while the second carries up to a 10-year prison term.

According to CNN, prosecutors and Schaffer's attorneys agreed to recommend that he get between three and a half and four and a half years in prison, based on how fruitful his cooperation is with the government.

In his plea agreement, Schaffer acknowledged that on January 6, 2021 he was in Washington to attend the "Stop The Steal" rally at the Ellipse in Washington, D.C. to protest the results of the presidential election, which he believed were fraudulent. Schaffer wore a tactical vest and carried bear spray, a dangerous weapon and chemical irritant used to ward off bears. When the rally finished, Schaffer joined a large crowd that marched from the Ellipse to the Capitol, where a joint session of Congress, presided over by Vice President Michael Pence, was in session to certify the electoral college vote results. Shortly after 2:00 p.m., members of the mob forced entry into the Capitol building, disrupting the joint session and causing members of Congress and the Vice President to be evacuated from the House and Senate chambers.

In his plea agreement, Schaffer admitted that after arriving on Capitol grounds, he walked past barriers intended to restrict access to the public and to a set of locked doors on the Capitol's west side. At approximately 2:40 p.m., Schaffer positioned himself at the front of a crowd that broke open a set of doors being guarded by four U.S. Capitol Police (USCP) officers wearing riot gear. Schaffer admitted to being among the first individuals to push past the damaged doors and into the Capitol building, forcing officers to retreat. Schaffer and others advanced toward five or six backpedaling USCP officers while members of the mob swelled inside of the Capitol and overwhelmed the officers. The officers ultimately deployed a chemical irritant to disperse the mob. Schaffer was among the people who were sprayed in the face, after which he exited while holding his own bear spray in his hands.

As part of the plea deal, Schaffer agreed to cooperate with investigators and potentially testify in related criminal cases, according to CNN. In return for Schaffer's assistance, the Justice Department might later urge the judge to show leniency during his sentencing.

As part of the agreement, the Justice Department has offered to sponsor Schaffer for the witness protection program.

The 53-year-old musician is the first Capitol riot defendant to reach a plea deal.
